County Commissioners Meeting

Item Summary:

On March 17, 2020, Mr. Richard Carter proposed to amend Article V, Section 10 of the Crossroads Commercial District, by adding 10.2.21, Microbreweries as defined by the State of Maryland, and by adding 10.2.22, Class D Alcohol retail business as defined by the State of Maryland. Microbreweries are a permitted use, subject to site plan review, in the Commercial zoning district; this amendment would permit microbreweries in the Crossroads Commercial zoning district, subject to site plan review. The Class D Alcohol retail business, as defined by the State of Maryland, would allow the applicant to sell beer, wine, and liquor to adults 21 or older for consumption on-premise.

 

At its meeting on May 7, 2020, the Kent County Planning Commission conducted a public hearing and reviewed proposed amendments to Article V, Section 10 Crossroads Commercial District of the Kent County Land Use Ordinance by adding 10.2.21, microbreweries as defined by the State of Maryland, and by adding 10.2.22, Class D Alcohol retail Business as defined by the State of Maryland. 

 

The Planning Commission voted unanimously to send a favorable recommendation to the County Commissioners finding the following:

 

  • The public need of the amendment is to allow for the development of small, locally owned businesses which will create jobs, and support tourism and economic development.
  • The proposal complies with the Comprehensive Plan and Land Use Ordinance. 
  • The zoning district is suited for this use. 

 

On August 11, the Kent County Commissioners held a public hearing on the proposed Home Code Rule. The applicant, Mr. Richard Carter, spoke in support of the proposed Bill. No members of the public spoke either in favor or opposition to the proposed legislation.
