Item Summary:

Third Reading Code Home Rule 6 – 2020 Campgrounds and Growth Allocation Zoning Text Amendment

  

On March 3,2020, the Board of County Commissioners of Kent County adopted Code Home Rule Bill 1-2020 to allow for expansion of campgrounds in existence before August 1, 1989, within the Resource Conservation District. The text amendment was determined to be a refinement of the County’s Critical Area Program which required approval by the Critical Area Commission. The Commission approved the language with conditions at its June 3, 2020, meeting. See attached letter.

 

The proposed ZTA is Code Home Rule Bill 6 -2020 to revise the Kent County Land Use Ordinance per the conditions of the State of Maryland, Critical Area Commission to amend Article V. District Regulations, Section 2. Resource Conservation District, Section 2.2 Permitted Principal Uses and Structures by striking “Campgrounds” from sub section 17 and adding a new sub-section 18 to address campgrounds as a separate use requiring growth allocation; and to amend Article V. District Regulations, Section 2. Resource Conservation District, Section 2.7 Resource Conservation District Environmental Standards, A. Resource Conservation District General Environmental Standards by adding a new sub-section 7 to address Growth Allocation provisions within the Resource Conservation District.

 

At its July 2, 2020 meeting, the Kent County Planning Commission reviewed the proposed amendments to the Kent County Land Use Ordinance, to allow for expansion of campgrounds in existence before August 1, 1989 within the Resource Conservation District when receiving growth allocation.  The Planning Commission recommended favorably. See attached letter.

 

On July 21, 2020 the Board of County Commissioners adopted Resolution 2020-15 to introduce the attached Code Home Rule Bill.

 

On August 11, 2002, a Public Hearing was held by the County Commissioners. Three members of the public spoke in opposition on this matter.

 

The revised Zoning Text Amendment has been drafted to include all CAC-required conditions in their entirety for County adoption.
